Salary: This position offers a salary range of $104,519 - $147,451, with potential for advancement up to $162,800 based on qualifications, equity, and hiring guidelines. Initial salary offers are determined by qualifications, experience, and available budget, and typically do not exceed $147,451.

Telework: A hybrid remote telework and in-office schedule option is available per applicable policies and procedures. 

DESCRIPTION: The Attorney General is the chief legal officer of the State of Maryland. The Office of the Attorney General (“OAG”) has the general charge, supervision, and direction of the State’s legal business, acting as legal advisor and representative of the major agencies, various boards, commissions, officials, and institutions of State GovernmentThe OAG also protects the public by civil enforcement of antitrust, civil rights, consumer protection, and securities laws and regulations and by the prosecution of organized crime, Medicaid fraud, environmental crimes, insurance fraud, state tax evasion, and other statutorily assigned matters. As Maryland’s 47th Attorney General, Anthony G. Brown leads the Office with a critical focus on equity, justice, and fairness. 

The Office of the Attorney General (OAG) is seeking an energetic, collegial, and highly proficient litigation attorney to fill a vacancy at the Assistant Attorney General VI level. The selected candidate will be assigned to represent and provide legal counsel to the Department of Public Safety and Correctional Services (Public Safety).  

This unit within the OAG is comprised of 17 attorneys and 5 professional staff and offers a dynamic and supportive environment. The breadth of litigation and legal matters arising from Public Safety and its various divisions presents excellent opportunities for both junior and senior attorneys to grow and advance their careers. 

Public Safety encompasses several major divisions, including the Division of Correction, Division of Parole and Probation, Division of Pretrial Detention and Services, the Maryland Parole Commission, the Patuxent Institution, the Maryland Police and Training Commissions, and the Sex Offender Registration Unit. The size and scope of the Department provide attorneys with the opportunity to explore new areas of substantive law and sharpen their litigation skills. 

Attorneys in this unit handle a broad spectrum of legal issues, including matters involving the Public Information Act, procurement law, Title VII of the Civil Rights Act of 1964, 42 U.S.C. § 1983, the Maryland Tort Claims Act, and the Maryland Fair Employment Practices Act. The Department also addresses emerging and complex legal issues such as transgender rights, body-worn camera policies, civil RICO claims, and equal employment opportunity matters. 

Attorneys are given meaningful responsibility, including managing their own caseloads, conducting depositions, briefing and arguing motions, handling judicial review cases, and assisting in trials. More experienced attorneys may specialize in particular areas, serve as first-chair in litigation, and mentor junior attorneys. The legal practice spans federal trial and appellate courts, Maryland circuit, district, and appellate courts, the Office of Administrative Hearings, and other administrative bodies. All of this takes place in a collegial environment that values flexibility, collaboration, and professional development. 

In this role, the Assistant Attorney General will provide comprehensive legal support to Public Safety. Responsibilities include conducting legal research and drafting legal memoranda, correspondence, and other legal documents. The attorney will advise the department on statutory interpretation, regulatory compliance, and legal issues affecting its programs and operations. The attorney will assist with matters before various boards and commissions and will be responsible for drafting and arguing dispositive and procedural motions. The role also involves managing discovery, including drafting and responding to written discovery requests, and taking and defending depositions. The attorney will represent Public Safety in trials and hearings and will be expected to provide sound legal advice across a wide range of subject areas as needed. 

EXPERIENCE: The ideal candidate will have a minimum of five years of relevant legal experience. The candidate should possess strong analytical and legal writing skills, along with experience handling matters in both federal and state courts. Preference will be given to candidates with experience in at least one of the following areas: 42 U.S.C. § 1983, the Maryland Public Information Act, Title VII of the Civil Rights Act of 1964, the Maryland Fair Employment Practices Act, or procurement law. Membership in the Maryland Bar (or the ability to waive in) is required. Admission to the United States District Court for the District of Maryland is preferred.
